CONTEST OFFICIAL RULES
(the “Official Rules”)

Fido Flip Game Contest
(the “Contest”)

These Official Rules govern the Contest. By participating or attempting to participate in the Contest, you will be deemed to have received, understood, and agreed to be legally bound by these Official Rules.

1.WHO are the Sponsors?

The Contest is sponsored and administered by Fido, operated by Rogers Communications Canada Inc. (“Fido”). Fido and any co-sponsor of are referred to collectively or individually as the “Sponsors”.

Although the Contest may be communicated, promoted, or administered by means of a third party social media or social networking service or site (a “Third Party Service”), the Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Service; any questions, comments or complaints regarding the Contest should be directed to Fido and not to any Third Party Service. Each entrant hereby releases each Third Party Services of all liability in connection with this Contest.

2.WHO MAY ENTER THE CONTEST?

The Contest is open to all legal residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry.

Notwithstanding the foregoing, the following individuals are not eligible to enter the Contest:

  1. employees, officers, directors, agents, and representatives of: (i) the Sponsors, or any of their respective parents, subsidiaries or affiliates; (ii) Launchfire Interactive Inc. (“Administrator”), or any of its respective parents, subsidiaries or affiliates; (iii) any prize supplier(s); and (iv) any other entity involved in the administration or fulfillment of the Contest;
  2. a household member of any of the individuals listed in (a), above, whether or not related;
  3. members of the immediate family (i.e. spouse, parent, child, sibling) of the individuals listed in (a), above.
3.WHEN DOES the contest START/END?

You may enter the Contest between 09:00:01 a.m. ET on October 04, 2017 and 11:59:59 p.m. ET on December 31, 2017 (“Entry Period”). All times referenced in these Official Rules are Eastern Time (ET).

4.how do I enter the contest?

No purchase is necessary to register for, or enter, the Contest.

The Contest consists of an on-line game available via the Fido My Account App – version 3.1.4 and up (the “App”) where entrants need to select circles to reveal if they are eligible to obtain an entry in a prize draw and to reveal random Instant Prizes (the “Game”).

Fido mobile customers must have access to a compatible device with iOS 8.2 or Android 4.2 and/or above (“Compatible Device”) to play the Game in the App. Should you not have access to a Compatible Device or should you not be a Fido mobile customer, refer to the alternative method of entry described in section 4(d) below.

a)Registration

To access the Game and play via the Appyou must first, if not already done, download the App by visiting http://fido.ca/apps using your Compatible Device and by following the on-screen instructions. Login to the App. Once logged in,

  • go to the ‟More” menu and click on the Banner to access the Contest website (the “Website”),
  • follow the on-screen instructions to register which will require you to provide your email address and to acknowledge your agreement to be legally bound by these Official Rules (“Registration”),

Limit of one (1) Registration per eligible entrant - you only need to register once to access and play the Game.

If you complete your Registration in accordance with these Official Rules, you will receive five (5) daily plays (each, a “Daily Play”). Following your Registration, you will receive five (5) Daily Plays with your first access to the Website on each Day remaining in the Entry Period (where a “Day” is defined as beginning at 12:01 a.m. ET and ending at 11:59 p.m. ET). Should you not access to the Website on any given Day during the Entry Period, you will not earn any Daily Plays on that Day.

IMPORTANT NOTE: An entrant may only access the Website by clicking on the Banner in the App. If an entrant leaves the Website, he/she must open the App and click on the Banner to re-visit the Website.

b)HOW DO I OBTAIN BONUS DAILY PLAYS?

You can receive bonus Daily Plays (in addition to those received in connection with your Registration and when you access to the Website thereafter – see (a) above for details) if you submit one or all four (4) Contest codes (each, a “Code”) following the on-screen instructions on the Website.

To obtain one of the Codes, visit any Fido Wireless Dealer or Fido Corporate store in Canada during the Entry Period and obtain the Code from a store representative. In addition to the Code available in its Wireless Dealer or Corporate stores, Fido will distribute three (3) Codes through its other channels in the course of business during the Entry Period.

You can submit each Code only once (1) during the Entry Period. For each Code submitted, you will receive two (2) bonus Daily Plays on the Day you submit the Code and two (2) bonus Daily Plays thereafter with your first access to the Website for each Day remaining in the Entry Period. Should you not access the Website on any given Day after having submitted a Code, you will not earn any Bonus Daily Plays on that Day with respect to that Code.

c)HOW DO I PLAY THE GAME?

To play the Game, you need to use a Daily Play. Follow the on-screen instructions to use one (1) Daily Play and press “Play Now!” (each a “Play”), following which you will be presented with a pyramid (the “Game Pyramid”) containing five (5) rows (each, a “Row”). The first Row on the bottom of the Game Pyramid will contain six (6) circles (“Row 1”), the second Row of the Game Pyramid will contain five (5) circles (“Row 2”), the third Row of the Game Pyramid will contain four (4) circles (“Row 3”), the fourth Row of the Game Pyramid will contain three (3) circles (“Row 4”), and the fifth Row of the Game Pyramid will contain two (2) circles (“Row 5”). Each Row corresponds to a type of Grand Prize (for example, Row 5 corresponds to Grand Prize E – see table below for details).

At the start of a Play, each Row will include one (1) circle that corresponds to a “Game Over” (each, a “Game Over Circle”) and the remaining circles in each Row will correspond with one (1) entry (each, an “Entry Circle”) into the corresponding Grand Prize Draw, as outlined in the following table:

At the start of a Play, you will have to click to select one (1) of the circles in Row 1 (each, a “Row 1 Selection”). If your Row 1 Selection corresponds to a Game Over Circle, the Play is over (and you will not receive any entries in connection with such Play) and you will have to use another Daily Play to begin a new Play, OR if your Row 1 Selection corresponds to an Entry Circle, you will be eligible to receive one (1) entry into the Grand Prize Draw that corresponds to Grand Prize A (each, a “Grand Prize A Entry”) and you will have the option to either select one (1) of the circles in Row 2 (each, a “Row 2 Selection”) or select to stop the Play (at which point you will receive the entry you are eligible to receive in connection with such Play).

If you choose to perform a Row 3 Selection and your Row 3 Selection corresponds to a Game Over Circle, the Play is over (and you will not receive any Entries in connection with such Play) and you will have to use another Daily Play to begin a new Play, OR if your Row 3 Selection corresponds to an entry Circle, you will be eligible to receive one (1) entry into the Grand Prize Draw that corresponds to Grand Prize C (each, a “Grand Prize C Entry”) and you will have the option to either select one (1) of the circles in Row 4 (each, a “Row 4 Selection”) or select to stop the Play (at which point you will receive the Entries you are eligible to receive in connection with such Play).

If you choose to perform a Row 4 Selection and your Row 4 Selection corresponds to a Game Over Circle, the Play is over (and you will not receive any Entries in connection with such Play) and you will have to use another Daily Play to begin a new Play, OR if your Row 4 Selection corresponds to an entry Circle, you will be eligible to receive one (1) entry into the Grand Prize Draw the corresponds to Grand Prize D (each, a “Grand Prize D Entry”) and you will have the option to either select one (1) of the circles in Row 5 (each, a “Row 5 Selection”) or select to stop the Play (at which point you will receive the Entries you are eligible to receive in connection with such Play).

If you choose to perform a Row 5 Selection and your Row 5 Selection corresponds to a Game Over Circle, the Play is over (and you will not receive any Entries in connection with such Play) and you will have to use another Daily Play to begin a new Play, OR if your Row 5 Selection corresponds to an entry Circle, you will be eligible to receive one (1) entry into the Grand Prize Draw that corresponds to Grand Prize E (each, a “Grand Prize E Entry”) and the Play is over.

Collectively, Row 1 Selections, Row 2 Selections, Row 3 Selections, Row 4 Selections and Row 5 Selections will be referred to as “Selections”.

a)HOW DO I PARTICIPATE IN THE CONTEST AND PLAY THE GAME IF I AM NOT A FIDO MOBILE CUSTOMER OR IF I AM A FIDO MOBILE CUSTOMER BUT DO NOT HAVE ACCESS TO A COMPATIBLE DEVICE?

To enter the Contest without playing the Game, mail a letter during the Entry Period with your name, address, day and evening telephone numbers, email address, age, the Contest name and the outcome number of the Game described in the Outcome Table below and that you would like to attempt (an “Outcome Attempt”), to the attention of “Fido Flip Game Contest / Mail-In Request”, Rogers Communications, Marketing, 1200 McGill College, Suite 800, Montreal, QC H3B 4G7 (each a “Mail-in Request”). Mail-in Requests must be postmarked within the Entry Period and be received prior to the Grand Prize Draws date to be valid.

Each Mail-in Request corresponds to one (1) Play (defined in section 4(c) above).

Upon receipt of a Mail-in Request, the Administrator or its designated representative will execute the Play in accordance with the Outcome Attempt included in such Mail-in Request. The following table outlines the odds of receiving the corresponding entries in connection with each Outcome:

Limit of one (1) Mail-in Request per envelope. Mail-in entrants are eligible to the same number of Plays as the number of Plays available via the App. Mail-in entrants will not be automatically informed whether or not they received corresponding entries in connection with an Outcome Attempt. If a mail-in entrant would like to receive such information, he/she must send a request along with a self-addressed, stamped envelope before the closing of the Entry Period to:

Mail-in entrant Outcome Attempts will be mailed out 6-8 weeks after the Contest Period. The Sponsor takes no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed Mail-in Request (all of which are void).

e)HOW DO I REVEAL AN INSTANT PRIZE?

PLAYING THE GAME VIA THE APP.In addition, when performing a Selection, you may be deemed a potential Online Instant Win Prize winner. Each of the Instant Prizes will be time stamped and the first person who performs a Selection on (or immediately after) a predetermined time stamp (as determined by the Sponsors in their sole discretion on the basis of its official records) will be deemed the potential winner of the corresponding Instant Prize.

The odds of winning an Instant Prize will change throughout the course of the Entry Period as Instant Prizes are claimed, and will depend on the number and timing of eligible entrants who perform Selections.

If you are deemed to be a potential Instant Prize winner, then you will instantly be presented with a pop-up page (“pop-up page”) with a description of the Instant Prize, along with a mathematical skill-testing question. If you correctly answer the skill-testing question, another pop-up page will display the information regarding the completing of a declaration and release form (see Section 8 below).

MAIL-IN ENTRANTS.Upon the reception of a Mail-In Request during the Contest Period, the Administrator or its designated representative will execute a Play on behalf of the mail-in entrant in accordance with the Outcome Attempt received to reveal if he/she is a potential Instant Prize winner. Potential Mail-in Instant Prize winners will be contacted by Administrator or its designated representative within ten (10) business days. If a potential Mail-in Instant Prize winner cannot be contacted within three (3) attempts or ten (10) business days after the first attempt of contact; such potential winner will be disqualified and will forfeit all rights to the applicable Instant Prize. Sponsors will have no obligation to award any Instant Prize that has not been claimed by a potential Mail-in Instant Prize winner. No communication will be entered with mail-in entrants who were not eligible to an Instant Prize.

5.cOULD MY ENTRies/my participation in the contest BE REFUSED OR REJECTED?

All entries, Mail-in Requests, Registrations, Daily Plays, Plays, Codes, Selections and any other type of information provided for the purposes of this Contest (collectively, “Contest-related Information”) are subject to verification at any time and for any reason. 

If it is discovered by the Sponsors (using any evidence or other information made available to or otherwise discovered by the Sponsors) that any person has attempted to:

  1. exceed any of the limits stated in these Official Rules; and/or
  2. use multiple names, identities, accounts, Registrations, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsors.

Disposable email addresses cannot be used for the purposes of this Contest. Sponsors are not responsible for any lost, late, incomplete, invalid, unintelligible or misdirected Contest-related Information, which may be disqualified (as determined by the Sponsors in their sole and absolute discretion).

In the event of a dispute as to who has submitted any given Registration and played the Game via the App, the applicable registration will be deemed to have been submitted by the account holder of the Fido mobile number associated with a Registration and entries in the Contest. An entrant may be required to show proof of being the authorized account holder of the Fido number associated with a Registration and entries in the Contest.

If it is discovered by the Sponsors (using any evidence or other information made available to or otherwise discovered by the Sponsors) that any person has attempted to:

  1. use multiple names, identities, accounts, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest;
  2. falsely enter an Code without obtaining an Code in accordance with these Official Rules;
  3. re-enter an Code a subsequent time after its first use; and/or
  4. enter an Code that has been falsified, manipulated or otherwise altered in any way (all as determined by Sponsors in their sole and absolute discretion);

then he/she may be disqualified from the Contest (as determined by the Sponsors in their sole and absolute discretion).

6.WHAT ARE THE CONDITIONS OF ENTRY?

By entering the Contest:

  1. you agree to be bound by these Official Rules and by the decisions of the Sponsors, which decisions are final, binding and conclusive;
  2. you represent and warrant that (i) your entry, including any material comprising your entry (e.g. name, user name, profile picture, etc., as applicable) and any material submitted with your entry (e.g. photograph, video, written submission, or other form of submission, as applicable) (all such material, collectively, the “Entry Material”) is original to you, (ii) you have all necessary rights in and to your Entry Material to enter the Contest, including the consent of any third parties whose personal information is included in your Entry Material, and (iii) your Entry Material does not contain, depict, include or involve content that is, or could reasonably be considered to be, inappropriate, unsuitable or offensive, as determined by the Sponsors;
  3. you understand and agree that your entry, including your Entry Material, will not be returned to you and may be moderated or edited by Fido as it deems appropriate;
  4. you grant to the Sponsors the irrevocable right to use your Entry Material in any media worldwide and for any purpose related to the Contest (or any similar contest), including the right to use, reproduce, modify, adapt, translate, or create derivative works from, your Entry Material without notification, compensation or additional consideration to you;
  5. you waive all claims of moral rights in any use of your Entry Material by Fido pursuant to the rights granted in these Official Rules;
  6. you agree that the Sponsors shall have the right at any time to require proof of identity or eligibility to enter the Contest; failure to provide any such proof upon request may result in disqualification;
  7. you release and forever discharge the Sponsors, the Administrator, their respective parents, affiliates, and subsidiaries, any other companies associated with the Contest, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns, as well as any Third Party Services, (collectively, the “Releasees”), and agree to indemnify and hold harmless each of the Releasees, from and against any and all claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, arising out of, or in any way related to, (i) your participation in the Contest, (ii) the awarding, receipt, possession, use or misuse of any prize, in whole or in part, or any travel or activity related to any prize, (iii) the use of any Entry Material or Publicity Material (defined below) in accordance with the rights granted in these Official Rules, or (iv) any breach of these Official Rules.
7.WHAT ARE The Grand Prizes?

There are five (5) types of grand prizes available to be won (each, a “Grand Prize”). The following Grand Prize table outlines the Game Row that corresponds to each type of Grand Prize, the quantity and approximate retail value (“ARV”) of such Grand Prize. Limit of one (1) Grand Prize per person.

8.WHAT ARE THE INSTANT PRIZES?

There are five hundred (500) instant prizes (each, an “Instant Prize”) available to be won. The following table outlines the respective types, number and ARVs of the Instant Prizes:

The number of Instant Prizes available to be won will decrease throughout the Contest as they are claimed in accordance with these Official Rules (see section 9 for details).

Collectively, the Instant Prizes and the Grand Prizes will be referred to as the “Prizes” or “prizes”.

9.HOW ARE INSTANT PRIZES WINNERS CONFIRMED?

ALL POTENTIAL INSTANT PRIZE WINNERS ARE SUBJECT TO VERIFICATION BY THE SPONSORS, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. A POTENTIAL INSTANT PRIZE WINNER OF A PRIZE IS NOT A CONFIRMED WINNER OF ANY INSTANT PRIZE, EVEN IF THE WEBSITE SHOULD SO INDICATE, UNLESS AND UNTIL THE SPONSORS HAVE VERIFIED HIS/HER COMPLIANCE WITH THESE OFFICIAL RULES AND THE POTENTIAL INSTANT PRIZE WINNER HAS BEEN NOTIFIED SUCH VERIFICATION IS COMPLETE. SPONSORS WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF THE VERIFICATION PROCESS DESCRIBED HEREIN.

BEFORE BEING DECLARED A CONFIRMED INSTANT PRIZE WINNER, each potential Instant Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid shown on the pop-up-page ; (b) sign and return within seven (7) days of notification the Sponsors’ declaration and release form, which (among other things): (i) confirms compliance with these Official Rules; (ii) acknowledges acceptance of the applicable Instant Prize as awarded; (iii) releases the Releasees (defined above in Section 7 above) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Instant Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsors, worldwide, in perpetuity and in any manner or media whatsoever (including without limitation print, broadcast or the internet, and on the list of winners).  If a potential Instant Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents, within the specified time; (c) cannot accept the applicable Instant Prize as awarded (for any reason); and/or (d) is determined to be in violation of these Official Rules (all as determined by the Sponsors in their sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the applicable Instant Prize) and the applicable Instant Prize will not be awarded.

10.HOW ARE GRAND PRIZES WINNERS SELECTED AND CONFIRMED?

On or about January 29, 2018 (the “Draw Date”) at the offices of the Administrator at 22 Hamilton Avenue North in Ottawa, Ontario at 12:00:00 ET, the Administrator will perform the following five (5) random draws to award the Grand Prizes (the “Grand Prize Draws”):

  1. Grand Prize A Draw: The Sponsors will conduct one (1) Grand Prize A draw (the “Grand Prize A Draw”) from among all eligible Grand Prize A Entries received during the Entry Period to select the potential winners of the respective Grand Prize A’s (starting with the selection of the potential winners of the Grand Prize As with the higher ARV and then the selection of the potential winners of the Grand Prize As with the lower ARV). The odds of winning a Grand Prize A will depend on the number of eligible Grand Prize A Entries received during the Entry Period.
  2. Grand Prize B Draw: The Sponsors will conduct one (1) Grand Prize B draw (the “Grand Prize B Draw”) from among all eligible Grand Prize B Entries received during the Entry Period to select the potential winners of the respective Grand Prize B’s (starting with the selection of the potential winners of the Grand Prize Bs with the higher ARV and then the selection of the potential winners of the Grand Prize Bs with the lower ARV). The odds of winning a Grand Prize B will depend on the number of eligible Grand Prize B Entries received during the Entry Period.
  3. Grand Prize C Draw: The Sponsors will conduct one (1) Grand Prize C draw (the “Grand Prize C Draw”) from among all eligible Grand Prize C Entries received during the Entry Period to select the potential winners of the respective Grand Prize C’s. The odds of winning a Grand Prize C will depend on the number of eligible Grand Prize C Entries received during the Entry Period.
  4. Grand Prize D Draw: The Sponsors will conduct one (1) Grand Prize D draw (the “Grand Prize D Draw”) from among all eligible Grand Prize D Entries received during the Entry Period to select the potential winners of the respective Grand Prize Ds (starting with the selection of the potential winners of the Grand Prize Ds with the higher ARV, then the selection of the potential winners of the Grand Prize Ds with the mid ARV and then the selection of the potential winners of the Grand Prize D’s with the lowest ARV). The odds of winning a Grand Prize D will depend on the number of eligible Grand Prize D Entries received during the Entry Period.
  5. Grand Prize E Draw: The Sponsors will conduct one (1) Grand Prize E draw (the “Grand Prize E Draw”) from among all eligible Grand Prize E Entries received during the Entry Period to select the potential winners of the respective Grand Prize E’s. The odds of winning a Grand Prize E will depend on the number of eligible Grand Prize E Entries received during the Entry Period.

The Administrator or its designated representative will make a maximum of three (3) attempts to contact each potential Grand Prize winner via the email address provided at the time of registration within ten (10) business days of the Draw Date. If a potential Grand Prize winner cannot be contacted within three (3) attempts or ten (10) business days of the Draw Date; then such potential Grand Prize winner will be disqualified (and will forfeit all rights to the applicable Grand Prize) and the Sponsors reserve the right, in its sole and absolute discretion, to randomly select an alternate potential winner from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential winner, with the necessary amendments). 

BEFORE BEING DECLARED A CONFIRMED GRAND PRIZE WINNER, each potential Grand Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may be administered over the phone or via the Sponsors’ declaration and release form); (b) sign and return within ten (10) business days of notification the Sponsors’ declaration and release form, which (among other things): (i) confirms compliance with these Official Rules; (ii) acknowledges acceptance of the applicable Grand Prize as awarded; (iii) releases the Releasees from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Grand Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsors, worldwide, in perpetuity and in any manner or media whatsoever (including without limitation print, broadcast or the internet, and on the list of winners).  If a potential Grand Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents, within the specified time; (c) cannot accept the applicable Grand Prize as awarded (for any reason); and/or (d) is determined to be in violation of these Official Rules (all as determined by the Sponsors in their sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the applicable Grand Prize) and the Sponsors reserve the right, in its sole and absolute discretion, to randomly select an alternate potential winner from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential winner, with the necessary amendments).

12.are there any prize conditions?

In addition to any prize conditions provided elsewhere in these Official Rules, any prize awarded in the Contest is subject to the following conditions:

  1. Prize value in these Official Rules is approximate only. You will not be compensated if actual prize value is lower than the value quoted in these Official Rules.
  2. The prize may be substituted, in whole or in part, with a prize or prize component of equal or greater value if the prize or prize component cannot be awarded for any reason.
  3. The prize must be accepted as awarded and may not be transferred, unless otherwise determined by the Sponsors. The prize may not be exactly as advertised. The prize is provided “as is” without representation or warranty of any kind by the Sponsors.
  4. The prize may not be resold.
  5. Any unused portion of the prize, once awarded, will be deemed forfeited. The prize will not be replaced if lost, destroyed, mutilated or stolen.
  6. Each Fido Visa Prepaid Card and any gift card are subject to the terms and conditions of the issuer.
  7. All costs and expenses associated with the use or redemption of any prize that is not explicitly indicated above as included in are the applicable winner’s sole responsibility.
  8. Device may be locked for use on the Fido network and does not include activation or any plan, which are the responsibility of the winner. Winner must comply with the applicable terms of service and Acceptable Use Policy of Fido should the device be activated and used on the Fido network. Any costs or expenses incurred by winner in claiming or using the device, including but not limited to the unlocking of the device, are the sole responsibility of the winner.
13.are there any prize conditions?

If you are a winner, the Sponsors may require you to appear in publicity related to the Contest or to any similar contest.

Without limiting the generality of the foregoing, by accepting a Prize:

  1. you grant to the Sponsors the irrevocable right to record, photograph or otherwise capture or document you, your likeness, your voice, or any statements you make regarding the Contest or the applicable Prize, by any available means;
  2. you agree that any such captured material, together with your biographical information, such as name or place of residence, or your Contest-related Information (collectively, all such materials, the “Publicity Material”) may be used by the Sponsors or their licensees, successors, or assigns (collectively, the “Publicity Parties”) in any media, whether now known or later devised, worldwide and in perpetuity, for advertising or promotional purposes related to the Contest or any similar contest. Any such use of the Publicity Material may include the reproduction, modification, adaptation, translation or creation of derivative works from your Publicity Material;
  3. you acknowledge that the Publicity Parties shall not be required to compensate you, notify you, or request your permission in connection with their use of any Publicity Material, unless otherwise prohibited by law; and
  4. you waive any rights that you may have or that may otherwise exist in connection with any use of the Publicity Material by any of the Publicity Parties, including any moral rights in any such Publicity Material.
14.HOW will MY PERSONAL INFORMATION be COLLECTED, USED AND DISCLOSED?

By entering the Contest, you consent to Fido’s collection, use and disclosure of your personal information in accordance with the Privacy Policy, available at http://www.fido.ca/consumer/terms/privacy-policy (the “Fido Privacy Policy”), for purposes of administering the Contest (including without limitation collection, use and disclosure by the Administrator to administer the Contest) as described in these Official Rules.

Over the course of participating in the Contest, you may be given the option to receive commercial emails or other communications of a commercial nature (collectively, “Commercial Communications”) from the Sponsors or other parties. Should you elect to receive Commercial Communications from Fido, your personal information will be used by Fido to that end, in accordance with the Fido Privacy Policy.

Your personal information may be disclosed to a third party in the following circumstances:

  1. in accordance with these Official Rules, or with your consent, or as otherwise permitted or required by law.
  2. if you elect to receive Commercial Communications from a party other than Fido, Fido will disclose your personal information to that other party for that purpose;
  3. if you are a potential prize winner, Fido may disclose your personal information to any prize supplier for purposes of prize fulfillment; and
  4. if you have been asked to sign and return a release of liability and consent to publicity form or other documentation in accordance with the terms of these Official Rules, Fido may disclose your personal information to any interested party, such as an entity who is released from liability.

Fido’s disclosure of your personal information to another party will cause your personal information to be subject to that party’s privacy policy and practices.

15.how DO the releasees LIMIT THEIR LIABILITY?

he Releasees assume no liability for the following:

  1. stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, jumbled, or garbled Contest-Related Information, transmissions, email, mail, or other communications;
  2. any error, omission, interruption, defect or delay in transmission, processing, or communication; failures or malfunctions of, or difficulties with, computer hardware or software, applications (including without limitation the App), telephones, telephone lines, telephone systems, or network, cable, satellite, server, websites (including without limitation the Website) or website connections;
  3. printing, typographical, or other errors appearing within these Official Rules, in any Contest-related advertisements, or in Contest-related materials;
  4. incorrect or inaccurate information, including where caused by application or website users, tampering, hacking, or by any equipment or programming associated or used in connection with the Contest;
  5. injury or damage to any computer or other device resulting from or otherwise related to participation in the Contest, the use of any website, or the downloading or accessing of any materials;
  6. anyone being incorrectly or mistakenly identified as a winner or potential winner; or
  7. any other errors, problems or difficulties of any kind, whether human, mechanical, electronic, or otherwise, relating in any way to the Contest, including those errors, problems or difficulties that may relate to the administration of the Contest, the processing of Contest-Related Information, the advertising of the Contest, the announcement of any Prize or Prize winner, or the cancellation or postponement of any event.
  8. If due to printing, production, online, internet, computer or other error of any kind, more Prizes are claimed than intended to be distributed or awarded according to these Official Rules (at any prizing level), then, in addition to having the right to terminate the Contest immediately (subject only to prior approval by the Régie des alcools, des courses et des jeux, if legally required), the Sponsors reserve the right, in their sole and absolute discretion to rescind invalid prize claims, conduct a random draw from amongst all eligible prize claimants (at the applicable prizing level) in order to award the correct number of Prizes. In no event will the Sponsors be liable for more than the number of Prizes as stated in these Oficial Rules (at any prizing level). If due to printing, production, online, internet, computer or other error of any kind, a Code is unusable for the purposes of this Contest as contemplated by these Official Rules, the applicable Code holder’s only remedy in this regard will be to receive another Code, while supplies last.
16.What laws apply to the contest?

The laws of the province or territory in which you reside apply to the Contest.

Any attempt to undermine the legitimate operation of the Contest may be a violation of criminal or civil laws. Should any such attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law.

17.CAN THE SPONSORS CANCEL OR AMEND THE CONTEST?

The Sponsors may cancel, modify, or suspend the Contest or amend these Official Rules for any reason whatsoever (subject only to prior approval by the Régie des alcools, des courses et des jeux, if legally required). For example, if for any reason the Contest is not capable of running as originally planned, the Sponsors may (subject only to prior approval by the Régie des alcools, des courses et des jeux, if legally required) adjust any of the dates, timeframes or other Contest mechanics, or suspend or cancel the Contest.

You may not amend these Official Rules in any way.

18.would the Sponsors ever DISQUALIFY or ban someone from a contest?

The Sponsors may disqualify without notice or ban someone from the Contest or any future contest for any other reason, including if the Sponsors find that a person has:

  1. resold or attempted to resell a prize, in whole or in part;
  2. tampered with or attempted to tamper with, or undermined or attempted to undermine, the legitimate operation of the Contest;
  3. provided false or misleading information;
  4. acted in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any person; or
  5. otherwise violated these Official Rules.
19.What HAPPENS if these official rules contradict other contest materials?

In the event of any discrepancy or inconsistency between these English Official Rules and disclosures or statements made by the Sponsors or appearing in other Contest-related materials (including without limitation the French Official Rules), these English Official Rules shall govern.

20.What HAPPENS IF PART OF THESE OFFICIAL RULES BECOMES UNENFORCEABLE OR DOES NOT APPLY?

If any part of these Official Rules is legally unenforceable or inapplicable, then that part will be deemed invalid; however, the remainder of these Official Rules will otherwise continue to be legally binding.

21.if i am a resident of quebec, is there any additional information i should know?

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
